Agreement

These Terms and Conditions govern your access to and use of DrivenToCollect, including our website, applications, vehicle collection management tools, checklist workflows, document storage, image storage, sharing features, and related services. By using DrivenToCollect, you agree to these terms.

Accounts

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to provide accurate information and to promptly update information when necessary. You must notify us if you believe your account has been compromised.

Authorized Use

You agree not to:

• Use the service for unlawful, fraudulent, deceptive, or harmful purposes.
• Access or attempt to access accounts, collections, vehicles, files, or systems without authorization.
• Interfere with, disrupt, reverse engineer, scrape, or overload the service.
• Upload malicious code, infringing content, or content you do not have rights to use.
• Misrepresent vehicle information, sale information, inspection results, or ownership details.

User Content

You retain ownership of vehicle records, photos, documents, notes, checklist responses, and other content you submit to the service. You grant DrivenToCollect a limited license to host, store, process, display, transmit, and back up that content as needed to provide and improve the service.

You represent that you have the rights and permissions necessary to upload and share your content through DrivenToCollect.

Vehicle Information and Checklists

DrivenToCollect is a recordkeeping and workflow tool. Checklist scores, inspection results, valuation fields, market readiness indicators, notes, and vehicle details depend on information entered by users and are not guarantees of condition, value, sale outcome, authenticity, title status, safety, or legal compliance.

Shared Pages and Invites

You are responsible for deciding who may access collections, vehicles, shared pages, and related records. Anyone with access to a valid shared link or invitation may be able to view the information made available through that link or invitation.

Third-Party Services

DrivenToCollect may rely on third-party providers for hosting, file storage, email, database infrastructure, analytics, security, or other operational needs. Those providers may process information as described in our Privacy Policy.

Fees and Paid Services

If paid features are offered, fees, billing terms, renewal terms, and cancellation terms will be provided at purchase or in a separate agreement. You are responsible for any taxes or charges associated with paid services unless otherwise stated.

Service Changes

We may modify, suspend, or discontinue features of the service at any time. We may also restrict or terminate access if we believe these terms have been violated or if continued access creates risk for users, the service, or third parties.

Disclaimers

DrivenToCollect is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and reliability.

Limitation of Liability

To the maximum extent permitted by law, DrivenToCollect will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, business interruption, or vehicle transaction losses.

Indemnification

You agree to defend, indemnify, and hold harmless DrivenToCollect from claims, damages, liabilities, losses, and expenses arising from your use of the service, your content, your violation of these terms, or your violation of rights of another person or entity.

Changes to These Terms

We may update these terms from time to time. The updated version will be posted on this page with a revised effective date. Continued use of the service after changes means you accept the updated terms.
